QuiqVox is a live polling and audience engagement service (the "Service") provided by Kivein Ltd ("Kivein", "we", "us"). By ticking the acceptance box on the join page or by using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You agree not to submit content that is unlawful, defamatory, abusive, obscene, discriminatory, harassing, or that infringes anyone's rights. You agree not to attempt to disrupt, overload, probe or gain unauthorised access to the Service. We may remove content and block access at our discretion, without notice, where we reasonably believe these Terms have been breached.
Questions and slides are created by presenters, not by Kivein. Kivein does not review or endorse presenter content and is not responsible for it. Any concerns about a session's content should be raised with the presenter or organiser in the first instance.
The Service is provided on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, error free or available at any particular time. We may change, suspend or withdraw the Service, in whole or in part, at any time without notice.
The Service, including its software, design and branding, belongs to Kivein Ltd or its licensors. QuiqVox and the QuiqVox logo are trading identities of Kivein Ltd. You keep ownership of the content you submit, but you grant Kivein and the session presenter a licence to display, store and process that content for the purpose of running the session and producing results and exports.
Nothing in these Terms excludes liability that cannot be excluded by law, including for death or personal injury caused by negligence or for fraud. Subject to that, to the fullest extent permitted by law: (a) Kivein excludes all implied warranties, conditions and terms; (b) Kivein is not liable for any loss of profit, data, business, goodwill or any indirect or consequential loss arising from use of, or inability to use, the Service; and (c) Kivein's total aggregate liability arising out of or in connection with the Service is limited to £100.
You agree to indemnify Kivein Ltd against claims, losses and costs arising from your breach of these Terms or your misuse of the Service.
We may update these Terms from time to time. Continued use after an update means you accept the revised Terms. If any part of these Terms is found unenforceable, the rest remains in effect. These Terms are governed by the laws of England and Wales and the courts of England and Wales have exclusive jurisdiction.
