1. Who we are
QuiqTap is a trading name of Kivein Ltd ("Kivein", "we", "us", "our"), a company registered in England and Wales. Our registered office is Pa103 Technology Centre, University of Wolverhampton Science Park, Glaisher Drive, Wolverhampton, WV10 9RU. You can contact us at hello@kivein.com.
These terms apply to your use of the quiqtap.com website and the web applications made available through it, including QuiqVox, QuiqSeat, QuiqQR, QuiqStart, QuiqGuard and QuiqTickets, together with any apps we add later (the "Services"). By using the Services you agree to these terms. If you do not agree, please do not use the Services.
2. The Services
The Services are browser based tools. Some are provided free of charge and others may require payment or a subscription. Where a Service is paid, the price and what is included will be made clear before you commit to buying. Free Services are provided as a convenience and may be changed, limited or withdrawn at any time.
We work hard to keep the Services available and reliable, but we do not promise that they will be uninterrupted, error free or available at any particular time. We may suspend or restrict access for maintenance, security or operational reasons.
3. Your account and your content
Some Services let you create content such as table plans, polls, QR codes, events or tickets ("Your Content"). You keep ownership of Your Content. You give us a limited licence to store, process and display Your Content only so far as needed to run the Services for you.
You are responsible for Your Content and for keeping any access credentials, links or codes secure. You confirm that Your Content does not infringe anyone else's rights and is not unlawful, offensive or misleading.
4. Acceptable use
You agree not to use the Services to do anything unlawful, harmful or deceptive. In particular you must not:
- use the Services to send spam, distribute malware or phishing links, or direct QR codes to harmful or misleading destinations;
- scan websites with QuiqGuard that you do not own or do not have permission to scan;
- collect personal data through the Services without a lawful basis for doing so;
- attempt to gain unauthorised access to the Services, other users' data or our systems;
- resell or misrepresent the Services as your own without our written agreement;
- use the Services in any way that could damage, overload or impair them.
We may suspend or terminate access for breach of these terms.
5. Event organisers and attendee data
If you use QuiqTickets, QuiqSeat, QuiqVox or similar Services to run an event or collect responses, you are responsible for the personal data of your attendees and respondents. In data protection terms, you act as the controller of that data and we act as a processor on your behalf, handling it only to provide the Service. You are responsible for telling your attendees how their data will be used and for having a lawful basis to collect it.
6. Intellectual property
The Services, including their design, code, branding and content (other than Your Content), belong to Kivein Ltd or our licensors. You may not copy, modify or redistribute them except as allowed by law or with our written permission. QuiqTap, the QuiqTap logo and the individual app names and logos are trade marks of Kivein Ltd.
7. Paid Services, cancellations and refunds
Where a Service is paid, the applicable price, billing period and cancellation terms will be shown at the point of purchase. If you are a consumer in the UK, you have legal rights in relation to services that are not performed with reasonable care and skill, and nothing in these terms affects those rights. To ask about a cancellation or refund, contact hello@kivein.com.
8. Liability
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be excluded or limited under English law.
Subject to that, the Services are provided "as is". We are not liable for loss of profits, loss of business, loss of data, or indirect or consequential loss arising from your use of the Services. For free Services, our total liability to you is limited to £100. For paid Services, our total liability is limited to the amount you paid us for the Service in the 12 months before the claim arose.
QuiqGuard provides automated indicators only. A clean result does not guarantee that a website is free of malware, and a flagged result does not prove that a website is harmful. You should not rely on QuiqGuard as a substitute for professional security advice.
9. Third party links and services
The Services may contain links to third party websites or rely on third party services. We are not responsible for the content or practices of third parties. QR codes created with QuiqQR point to destinations chosen by their creators, not by us.
10. Changes to the Services and these terms
We may update the Services and these terms from time to time. If we make a significant change to these terms we will take reasonable steps to bring it to your attention, for example by posting a notice on the website. The date at the top of this page shows when the terms were last updated. Your continued use of the Services after a change means you accept the updated terms.
11. General
If any part of these terms is found to be unenforceable, the rest continues to apply. These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except that if you are a consumer living in Scotland or Northern Ireland you may also bring proceedings in your local courts.
